Stalking Charges in Colorado


Under Col­orado law, “stalk­ing” is a seri­ous crime and is clas­si­fied as a Class-5 felony.  Stalk­ing is com­mit­ted when an indi­vid­ual directly, or through another per­son, know­ingly com­mits any of the following:

1) Makes a cred­i­ble threat to another per­son and, on more than one occa­sion, fol­lows, approaches, con­tacts, or sur­veils that per­son, a mem­ber of that person’s imme­di­ate fam­ily, or some­one with whom that per­son has or has had a con­tin­u­ing rela­tion­ship; or

2)  Makes a cred­i­ble threat to another per­son and, on more than one occa­sion, makes any form of com­mu­ni­ca­tion with that per­son, a mem­ber of that person’s imme­di­ate fam­ily, or some­one with whom that per­son has or has had a con­tin­u­ing rela­tion­ship; or

3)  On more than one occasion—follows, approaches, con­tacts, sur­veils, or makes any form of com­mu­ni­ca­tion with another per­son in a man­ner that would cause a rea­son­able per­son to suf­fer seri­ous emo­tional dis­tress, and does cause that per­son to suf­fer seri­ous emo­tional dis­tress. This includes a mem­ber of that person’s imme­di­ate fam­ily, or some­one with whom that per­son has or has had a con­tin­u­ing relationship.

Cred­i­ble threat” is defined as a threat, phys­i­cal action, or repeated con­duct that would cause a rea­son­able per­son to be in fear of his or her safety, or the safety of his or her imme­di­ate fam­ily, or of some­one with whom the per­son has or has had a con­tin­u­ing relationship.

Stalk­ing is clas­si­fied as an “extra­or­di­nary risk crime,” mean­ing that a stalk­ing con­vic­tion will often result a length­ier sen­tence than gen­er­ally accom­pa­nies a Class 4 or 5 felony.  C.R.S. § 18–1.3–401 (10).  In addi­tion, if the Defen­dant has a prior stalk­ing con­vic­tion, the charge is upgraded to a Class-4 felony.  The neg­a­tive social stigma atten­dant to stalk­ing con­vic­tions also have the poten­tial to seri­ously impact a convict’s future employ­ment opportunities.
